These Terms and Conditions (“Terms”) govern your use of awisedesign.com (the “Site”), operated by A-Wise Design (“A-Wise Design,” “we,” “us” or “our”) of Garner, North Carolina. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
Our services
A-Wise Design provides event planning, coordination, design and styling, custom balloon designs, event rentals, DJ services, destination event planning and home staging. Information on the Site describes our services in general terms and is not an offer that can be accepted. Services, availability and pricing are confirmed only in a written proposal or service agreement.
Quotes, consultations and bookings
- Submitting a quote request or booking a consultation does not reserve your date or create a contract.
- Your date is reserved only after you sign our service agreement and pay any required retainer or deposit.
- Payment schedules, cancellations, refunds, rescheduling, rental care and damage, setup and venue requirements, and other booking details are governed by your signed service agreement. If that agreement conflicts with these Terms, the agreement controls.
- Quotes are estimates based on the information you provide and may change if event details, guest counts, designs or vendor costs change.
Event rentals and balloon designs
Rental inventory, colors and balloon materials vary with availability. Photos, graphics and descriptions on the Site are examples of our style and may not show the exact items or colors used for your event. Balloon designs can be affected by heat, sun, wind and other weather, and we are not responsible for changes caused by conditions outside our control.
Use of the Site
You agree to use the Site only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access, submit false information, or send spam or harmful code through our forms.
Intellectual property
The Site and its content, including the A-Wise Design name, logos, mascot illustration, text, graphics, photos and design, are owned by or licensed to A-Wise Design and are protected by copyright and trademark law. You may not copy, reproduce, distribute or use them for commercial purposes without our written permission. Partner and member logos belong to their respective owners.
Reviews and testimonials
Reviews shown on the Site are shared by real clients. Individual results and experiences vary.
Third-party links
The Site links to third-party websites such as Instagram, Facebook, Google and our partners. We do not control and are not responsible for their content, policies or practices.
Disclaimer
The Site is provided “as is” and “as available.” To the fullest extent allowed by law, we make no warranties of any kind about the Site, including that it will be error-free, uninterrupted or free of harmful components.
Limitation of liability
To the fullest extent allowed by law, A-Wise Design will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Liability for services we provide is governed by your signed service agreement.
Indemnification
You agree to indemnify and hold harmless A-Wise Design from claims arising out of your misuse of the Site or violation of these Terms.
Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Wake County, North Carolina.
Changes to these Terms
We may update these Terms from time to time. The effective date above shows when they were last changed. Continued use of the Site after changes means you accept the updated Terms.
